Understanding Custody Jurisdiction in Oklahoma Courts

Today, we’re talking about jurisdictional questions in child custody cases — specifically, how Oklahoma courts handle them.
Importance of Addressing Jurisdictional Questions
If you or someone you know is in the middle of a custody case and believes the court doesn’t have jurisdiction over the child, one of the parents, or even the entire case, that issue must be addressed before almost anything else, except a child’s immediate safety.
This is laid out in Oklahoma law, Title 43, Section 551-107, which states that if a party raises a question about the court’s authority in a custody matter, the court must give it priority on the calendar and resolve it quickly.
In plain terms, if jurisdiction is questioned, the court has to stop and address that issue first before moving forward with the rest of the case.
