Understanding Simultaneous Custody Proceedings in Oklahoma

Today, we’re discussing simultaneous child custody proceedings and how theyโre handled in Oklahoma. If it’s discovered that a custody case is pending both in Oklahoma and another state, the Oklahoma proceeding will automatically pause.
Jurisdiction and Venue Considerations
At that point, the Oklahoma court will review documentation from both jurisdictions to determine which state has proper jurisdiction and venue. If Oklahoma is found not to be the appropriate or more convenient forum, the court will dismiss the case here, allowing the case in the other state to proceed.
On the other hand, if Oklahoma is determined to have jurisdiction, the other state will be asked to dismiss its case, and proceedings will continue here. This applies to initial custody filings, modifications, or other custody-related proceedings.
The Importance of Resolving Jurisdiction
The law is designed to prevent two states from issuing conflicting custody orders, which could lead to enforcement issues. In short, only one state should proceed at a time, and that determination hinges on where jurisdiction properly lies.
