Oklahoma has the power and the statutory law, along with a blueprint of how to take a case from another state and bring it under the jurisdiction of Oklahoma. This applies to both custody determinations and other orders that might have originated from another state.
The Importance of Registering Your Foreign Judgment
A lot of people receive their custody determinations and judgments from a different state and leave them unregistered when they move. This can lead to problems since any modifications or necessary changes require returning to the state where the original order was issued.
Fortunately, there is a workaround. If you have received a custody determination or custody orders from another state, you can petition the court in Oklahoma to register your custody determination as a foreign judgment. This allows the case to be managed under Oklahoma law.
The Registration Process Explained
To register your custody determination, you must petition the court and provide proper notice to the other party involved. Once you’ve submitted all the necessary paperwork and certified copies of your previous order, the notice you give starts a countdown for the other party.
The other party has 20 days to respond. If they fail to do so, your foreign judgment and custody order are automatically accepted by the state of Oklahoma. However, if they do respond within the time frame, they have the right to a hearing, where they can object to the registration.
