Understanding Oklahoma’s Unique Temporary Visitation Process Explained
Hello, I’m Oklahoma City divorce attorney Dillan Savage of Wirth Law Office. Today we’re going to be talking about Title 43 Section 551-304, entitled Temporary Visitation. This section outlines the power of an Oklahoma court to intervene and enforce a visitation schedule over a custody determination or custody order that an Oklahoma court does not have jurisdiction to modify.
Instances of this occurring are quite rare. In fact, I myself have never encountered a case of this nature. However, if you find that your visitation rights are being denied despite having legal rights, you might have options available.
What to Do If Your Visitation Rights Are Denied
If your custody determination order originates from a court that has jurisdiction outside of Oklahoma, you may still have the opportunity to seek help. In situations where you cannot file in that originating court for any reason, you can request that Oklahoma courts intervene. This request would aim to provide an enforcement order to allow you to temporarily obtain and enforce your visitation schedule, as originally established by the other court.
It is crucial to understand that this is merely a stopgap measure. While it provides immediate relief, it is not a permanent solution. As soon as you have the opportunity, you need to go to the court with proper jurisdiction to either modify or request enforcement of your visitation schedule.
Taking Immediate Action
Oklahoma courts have the ability to enforce visitation schedules even when jurisdiction is in question. This means that if you have a legitimate case, the court may grant you temporary enforcement until you can go back to the appropriate jurisdiction. If you found this information helpful or believe it could assist someone else, I encourage you to pass it along.
