Understanding Railroad Liability for Fire Damage in Oklahoma
Hello, I’m Oklahoma City business law attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area.
Today, we’re going to talk about the liability of Oklahoma railroads when a fire is caused by the maintenance or operation of their railroad lines.
You can find more details on this in Title 2, Section 16-40 of the Oklahoma Statutes. But hereโs the simple breakdown:
The Basis of Railroad Liability
If a railroad is operating within the state of Oklahoma and has tracks or railroad lines here, and a fire originates from the use or operation of those lines, then the railroad company is liable for any damages resulting from the spread of that fire.
So, whether it’s due to sparks from the tracks, faulty maintenance equipment, or other operational issues, the railroad is responsible for any resulting property damage caused by the fire.
