Understanding Your Rights Against HOA Discrimination

Today, we’re continuing our video series on what HOAs cannot do—or things you have the right to do that HOAs can’t prevent. This video focuses on the Federal Fair Housing Act and the Oklahoma Fair Housing Act from a general perspective.
Specifically, we’re looking at what HOAs cannot do, and that is this: An HOA cannot put in place a discriminatory rule.
Discriminatory Rules Are Not Legal
This means if a rule discriminates against or negatively affects you based on your:

- Age
-
- Nationality
-
- Gender
-
- Disability
-
- Familial status
-
- Sexual orientation
—then that rule is not legal. It’s a violation of both the Oklahoma Fair Housing Act and the Federal Fair Housing Act.
Additionally, even if a rule doesn’t appear discriminatory on its face, but it causes a discriminatory effect, it’s still very likely to be in violation of these housing laws. Just because a rule seems neutral doesn’t mean it’s lawful if the outcome unfairly impacts a protected group.
