Oklahoma’s Agricultural Law: Understanding Property Seizure Rights
Hello, I’m OKC business attorney Dillan Savage with Wirth Law Office, and I primarily practice in the Oklahoma City, Oklahoma area. Today, we’re going to discuss the authority of the Oklahoma Department of Agriculture to seize and forfeit property in certain situations.
Property Affected by Agricultural Code Violations
If an individual or company violates the Oklahoma Agricultural Code, the Department has the authority to seize property such as vehicles, farming equipment, implements of husbandry, and livestock. If livestock is being transported or has already been slaughtered, it may also be subject to seizure.
Furthermore, if any equipment or property—such as vehicles, airplanes, computers, or other devices—has been used in the theft of livestock, those items are subject to forfeiture. In addition, any proceeds or financial gains obtained through the theft or unlawful conduct may be seized and forfeited to the State.
Consequences of Violating the Agricultural Code
In summary, violating the Oklahoma Agricultural Code can result in the loss of any property used in the commission of the offense, as well as any profits gained from it.
