Understanding the Authority of the Oklahoma State Board of Agriculture
Hello, I’m OKC business attorney Dillan Savage with Wirth Law Office, and I primarily practice in the Oklahoma City, Oklahoma area. Today, we’re going to discuss the Oklahoma State Board of Agriculture’s authority to conduct investigations and search bags, packages, and other containers related to agricultural products.
Inspection Powers and Compliance
Under Title 2, Section 2-14 of the Oklahoma Statutes, the State Board of Agriculture and its agents are authorized to inspect products, containers, and related items, and to conduct investigations to ensure compliance with Oklahoma’s agricultural laws and codes.
If an individual denies access to any packages or containers during the course of an investigation, the Board and its agents are also empowered—under the same statute—to seek and obtain a warrant through the District Courts to proceed with the investigation.
