Understanding The Oklahoma Competitive Livestock Market Act
Hello, I’m Oklahoma City attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area. Today we’re going to be talking about the Competitive Livestock Markets Act. This particular Act spans several sections, all found in Title 2 under Agriculture—specifically, Sections 9-160 through 9-164.
This law applies to individuals in the business of livestock, meat, meat products, and other unmarked livestock byproducts. If you’re in this industry, it’s important to understand what you can and cannot do under the Act.
The Purpose and Regulations of the Act
The purpose of the Act is to protect individuals already in the business and those trying to enter it. At its core, the law is pretty intuitive: don’t engage in unfair, deceptive, or discriminatory practices while conducting business.
This means:

- Do not sell, transfer, or buy livestock or related products in a way that tends to create a monopoly or otherwise restrain commerce.

- Do not engage in price manipulation.

- Do not conspire with others to divide territory or control specific markets—essentially creating a market where only your business operates in a certain area.
Additionally, as you might expect, you are prohibited from aiding or abetting any unlawful activities.
Taking Action Against Violations
If you are a victim of these kinds of practices and have suffered actual damages, you may pursue a civil action. This could include a request for declaratory relief, which simply means asking the court to acknowledge that the violations caused harm and order the responsible party to make it right.
You may also seek a restraining order to stop the offending party from continuing these actions. And if enough people have been affected, the matter could even rise to the level of a class action lawsuit.
