HOA Foreclosure Risks
HOAs, through their fines and fees, can actually attempt to foreclose on your home. If your fines add up high enough through their internal process, they may try to move forward with foreclosure to recover what they claim you owe.
However, if you are an active duty member of the military—including members of the National Guard or Reserves on active orders—the Servicemembers Civil Relief Act protects you. It halts foreclosure and repossession proceedings while you’re on active duty. This could include your home, your vehicle, or other personal property.
Broad Protections Offered by the SCRA
This protection doesn’t only apply to HOAs—it applies across all civil proceedings. No individual or business can obtain a default judgment or repossess property from you without meeting the strict conditions laid out in the SCRA.
In most cases, this comes into play when a servicemember is deployed. The SCRA offers a wide range of protections:
