Understanding Minors’ Contractual Obligations in Oklahoma Law
Hello, I’m OKC business law attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area. Today we will be discussing contracts that minors may not disaffirm or get out of without being held accountable.
In an earlier video, I discussed the fact that minors usually have the power to disaffirm or negate a contract that they have entered into. However, there are certain circumstances where minors cannot disaffirm their contracts.
When Minors Cannot Disaffirm Contracts
More specifically, if the minor has entered into a contract that would normally be considered valid, and they have contracted to pay the reasonable value of things necessary for their support, or the support of their family, while not being under the care of a parent or guardian, they can be held accountable for that contract.
In other words, if a minor enters into what would normally be an enforceable contract for reasonable necessities for their family or themselves while not being under the care of a parent or guardian who could provide those same necessities, that contract can be enforced here in Oklahoma.
