Understanding Legalities of Timber Removal in Oklahoma
Hello, I’m Oklahoma City business law attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area.
Today, we’re going to discuss the removal of timber and timber products from lands owned by the State of Oklahoma—and the penalties that may result if someone removes those materials without proper authorization.
State-Owned Timber: When Is Removal Legal?
Timber and timber products found on land owned by the State of Oklahoma may be removed only for public improvements or utility projects. To do this legally, you’ll need to apply and request permission through the appropriate channels.
Importantly, no officer or agent under the Department of Forestry and Agriculture may authorize such removal unless the Director of Forestry gives express approval. If you apply and receive that approval, you may then remove the timber as permitted.
Penalties for Unauthorized Removal
However, if you remove timber without that permission, or if agents bypass the proper approval process, you could be found guilty of a felony. This is a serious matter that underscores the importance of complying with state regulations.
-
- First Offense: Up to 1 year in jail, a fine of up to $1,000, or both.
-
- Subsequent Offenses: Up to 3 years in prison, a fine of up to $5,000, or both.
So, it’s very important not to take timber or timber products from state land unless you’ve gone through the proper procedures and received the required authorization.
