Understanding Oklahoma’s Air Navigation Safety Laws
Hello, I’m Oklahoma City business law attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area. Today, we are going to be talking about Oklahoma’s laws put into place to prevent the erection of dangerous structures to air navigation. More specifically, we are going to be looking at Title III, Section 102.1 in Oklahoma’s laws.
This statute itself is called Permit for Erection, Alteration, or Modification of Certain Structures. So, each person shall be required to secure from their local airport zoning authority—or, in the absence of a local airport zoning authority, the Oklahoma Department of Aerospace and Aeronautics—a permit allowing them to erect, alter, or modify a structure which would, in turn, with that creation, modification, or alteration, exceed the federal obstruction standards.
Key Requirements for Permits
You can find those standards under 14 CFR Part 77. You can just type that into Google and find those standards. More specifically, you can also type in 14 CFR Part 77.17 to get to the real heart of the matter. This statute—this Oklahoma statute—will also give you more detailed information as well, but you are going to have to get that permit from that, again, local airport zoning authority or the Oklahoma Department of Aerospace and Aeronautics.
This is to prevent dangers to our air navigation within the state of Oklahoma.
