Understanding Airport Hazards in Oklahoma
Hello, I’m Oklahoma City business law attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area. Today we are going to be talking about airport hazards. This may seem like common sense, but as you might imagine, when it comes to government and bureaucracy, they tend to want to be as specific as possible to avoid as many problems in the future as possible.
They actually define what an airport hazard is, and they also outline the power to use public funds for the public interest in resolving these airport hazards. If you want to read a bit more about this, you can go to Title III, Section 102. That statute is titled Airport Hazards Contrary to Public Interest, but the down and dirty of this is: essentially, it is a danger to the public when someone creates an airport hazard, or if just an airport hazard exists.
Impact of Airport Hazards on Public Safety
It endangers lives, property, and so forth—both in the occupants of the airport itself and in the surrounding area. You would be looking at some type of obstruction or something that would, in effect, reduce the ability to use the airport—where planes could land, and so forth—things like that.
So what they do is they go into this statute and they say, “Look, for the purpose of getting rid of these hazards and for public safety, we can expend funds, acquire land, or property interest to avoid or get rid of these airport hazards for, again, the best interest of the public.”
