Understanding Municipal Authority in Airport Disposal Processes
Hello, I’m Oklahoma City attorney Dillan Savage of Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area. Today, we are going to be talking about the power and ability of a municipality to dispose of an airport that it possesses.
I have previously discussed the abilities and power of a municipality to acquire an airport through buying, leasing, or eminent domain. In the event, however, that a municipality needs to get rid of or otherwise dispose of an airport that is in their possession—or if it’s not an airport, it could be a vertiport or air navigation facility—they do, as that municipality, can do so. They can go through and, while still required to follow the normal laws, they can sell, lease, or otherwise dispose of that airport, vertiport, or air navigation facility.
Legal Procedures for Disposal
Again, they have to follow the normal laws as required—you don’t get to skirt around it. If you want to look a bit more into this, and whether or not a municipality is not following the procedures correctly—or if you work for the municipality and want to make sure that you do follow these laws correctly—you could go to Title III, Section 65.4. There are versions 1 and 2, and you should look that over.
