Essential Information for a Smoother Divorce Process
Hello, I’m Oklahoma City family law attorney Dillan Savage with Wirth Law Office, and I practice primarily in the Oklahoma City, Oklahoma area.
Today, we’re going to be talking about what you can do to make getting a divorce simpler—for both yourself and your attorney. If you’re moving forward with a divorce—whether your spouse has already filed or you’re the one planning to file—it’s important to bring certain information that will make the process smoother and more affordable.
Key Information to Gather
Start with basic information: Bring the full names of both you and your spouse. You should also know the date and place of your marriage. Most people remember their anniversary, and it’s helpful to know the month, day, year, and location of the marriage.
Next, we look at jurisdiction and venue. In Oklahoma, either you or your spouse must have resided in the state for at least six months, and in the county where you’re filing for at least 30 days.
Details About Children and Property
Then we consider whether there are children involved. If so, you’ll need to provide:
-
- The number of children
-
- Their initials and birthdates
-
- Whether the children are tribal members
-
- Where the children have lived for the past five years
-
- With whom they have lived during that time
If there’s already a child support case, such as one opened during a long-term separation, your attorney will need those details too.
We’ll also talk about equitable distribution of property—which just means a fair division of marital property. Bring a list of major assets such as the marital home, vehicles, or other big-ticket items. Personal items generally stay with each person, but dividing shared property can get complicated.
Financial Information to Provide
In terms of finances (especially for child support), be prepared to share:
-
- Your gross monthly income
-
- Who provides medical insurance for the child or children
Having this information ready will make your meeting with an attorney much more productive.
