Understanding Monetary Penalties Under the Oklahoma Agricultural Code
Hello, I’m OKC felony defense attorney is Dillan Savage with Wirth Law Office, and I primarily practice in the Oklahoma City, Oklahoma area.
Today, we’re going to talk about the fines and penalties you may face if you violate the Oklahoma Code of Agriculture, as well as the process you might go through if you’re accused of such a violation.
The Administrative Process of Violations
If you are allegedly in violation of the Agricultural Code, you will likely receive notice of proceedings in an administrative court through the Oklahoma Department of Agriculture. This administrative court may appoint an administrative law judge, and the hearing may be held:
-
- In the county where the alleged violation occurred,
- In the county where you reside,
- Or at the Department of Agriculture offices in Oklahoma.
It’s important to note that while the Department often handles these matters administratively, they may also choose to proceed through district court in certain cases.
Potential Fines and Legal Consequences
If you are found to have violated the code, you may be fined anywhere from $100 to $10,000 per violation. Continued violations can lead to escalating consequences—including potential misdemeanor or felony charges, depending on the severity and nature of the conduct.
Each day that a violation continues may be treated as a separate offense, compounding penalties. In addition to fines, you may also be ordered to pay attorney’s fees, court costs, and any additional penalties the court deems appropriate.
The more serious or ongoing the violation, the more significant the potential consequences.
